Mexico Cannabis Legalization, a Two-Sided Process

To obtain CBD in Mexico, one must go underground on the black market, risking arrest each time. Medical marijuana is technically legal in Baja California and throughout Mexico. It was legalized on the federal level in 2017. But the legal framework and practical guidance for local jurisdictions that would allow patients to actually possess it were never finalized by the Mexican equivalent of the United States Food and Drug Administration and the Ministry of Health. Besides that, the use of medical marijuana remains a social taboo.

Now Mexico is poised to become the third country in the world to federally legalize the recreational use of marijuana. But some advocates of legalization say that because of the way the law is written, similar problems could limit people’s ability to actually obtain and use a practical amount without a risk of arrest.

The Mexican penal code treats marijuana and CBD exactly the same. Unlike THC, CBD, another active compound in cannabis, does not cause the user to feel high or intoxicated. Right now, having even very small amounts of CBD – more than five grams – for any type of use – can land you in Mexican jail, according to legal professionals.

It is a really huge contemporary problem in Mexico that so many people are imprisoned for simple possession. Cannabis activists demand urgent remedy to this situation. In their point of view punishment for possession should be completely eliminated within this new law. The time is coming for society to embrace the medical benefits of marijuana and to put its old prejudices on the effects of CBD behind it.
