Spanish Tobacco Shops Selling CBD, Legal or Illegal?

At the beginning of the year 2020, CBD buds suddenly began to be seen in the windows of tobacco shops.

We all wonder how, when and why, this great change has emerged from one moment to another throughout Spain . Particularly in Catalonia, the Basque Country and Navarra, since previously we could only find the legal sale of CBD buds in cannabis associations.

Well, the Ministries of Finance and Health say that the distribution of cannabidiol is illegal.

Despite the fact that, the WHO considers it a safe and non-addictive component of marijuana. The EU Court of Justice has just ruled that it cannot prohibit its importation from another community state. For example from states where the use of medical cannabis is already regularized, such as Germany or the Czech Republic. Therefore there is a contradiction. Could we say that perhaps it is a loophole?

For now we know that tobacco shops must declare the products they sell, if these products may affect the safety of users, they may declare ineffectiveness by not declaring state fees and therefore, the irresponsibility of the tobacco company.

Legal or illegal?

At the moment, cannabis, regardless of the THC content, follows the old European laws, which are still prohibited from sale, something that could change, since as we know, last week cannabis was removed from the European list of the most harmful narcotics.
Unfortunately, the Spanish government is currently governed by the old law, as it has not yet been updated.

Meanwhile, this type of product can be sold with the authorization of the Spanish Agency for Medicines and Health Products (AEMPS). The sale of oils and other derived products with an amount less than 0.2% THC are also allowed. Although from now on it will be 0.3% due to the European decision of the past weeks.

In short, the Commissioner for the Tobacco Market wishes to warn all operators that the commercialization of cannabis products. Regardless of their content in THC, is prohibited by law. Therefore, any breach of this prohibition It can lead to the corresponding administrative or even criminal responsibilities. To be imposed by the competent authorities in each case.

That said, if you could choose and it was totally legal to buy CBD in tobacco shops, would you still buy CBD in your cannabis association or would you rather go to the tobacco shop instead?
