CHILE: The Commission rejects the initiative to legalize cannabis.

The initiative to include the right to consume cannabis in the new Constitution was not approved by the Fundamental Rights Commission of the Chilean Constitutional Convention. 

Despite 44,000 signatures from citizens, the Commission rejected the proposal to legalize cannabis. 

According to ADN Radio, the proposal, which sought to end the criminalization of the cultivation and consumption of marijuana for legitimate purposes, was rejected by the Fundamental Rights Commission of the drafting body. In this way, it was rejected with 10 votes in favor, 21 against, and two abstentions.

More than 44 thousand signatures were collected for the Commission to allow cannabis in the country. The proposal had also been sponsored by 43 organizations specialized in the cultivation and consumption of cannabis for medicinal purposes and had the signature of the deputy-elect Ana María Gazmuri, from the Daya Foundation.

The initiative, called “Cannabis to the Constitution Now,” aimed to legalize the self-cultivation and consumption of cannabis.

“The state recognizes as the limit of its faculties, attributions, and powers, personal sovereignty, autonomy over their own bodies and human dignity, respecting the free development of personality, privacy and the search for wellness, pleasure and comprehensive health. This includes the uses of cannabis and other psychoactive substances of plant or synthetic origin,” stated the proposal.

The proposal supported the use of cannabis and other psychoactive substances such as psilocybin mushrooms or ayahuasca. 

The proposal pointed out that “a systematic violation is exercised towards the essential dignity and personal sovereignty of people who voluntarily grow plants and consume entheogenic substances for legitimate purposes.” 

The Commission also met to discuss the right to safe abortion called “it will be law”. This proposal was approved by the Convention, with 24 votes in favor, eight against, and only one abstention reported Bio-Bio Chile. The Commission also approved a popular initiative on gender identity.
