Un juge a annul\u00e9 une sanction de 601 euros \u00e0 un homme qui avait \u00e9t\u00e9 surpris avec 0,55 gramme de cannabis \u00e0 l'int\u00e9rieur de sa voiture, n\u2019\u00e9tant pas un lieu public. <\/p>\n\n\n\n
La loi B\u00e2illon, connue comme loi de s\u00e9curit\u00e9 citoyenne est en vigueur depuis 2015. Elle punit la d\u00e9tention ou la consommation de drogue dans la rue et dans les lieux ou transports publics de 601 \u00e0 30 0000 euros d\u2019amende. La loi ne pr\u00e9cise en revanche pas ce qu\u2019il en est de la consommation \u00e0 l\u2019int\u00e9rieur d\u2019un v\u00e9hicule gar\u00e9e sur la voie publique. <\/p>\n\n\n\n
Un juge de la ville de Ja\u00e9n a annul\u00e9 une amende de 601 euros inflig\u00e9e \u00e0 un homme surpris avec 0,55 gramme de haschisch dans sa voiture.<\/p>\n\n\n\n

L\u2019arr\u00eat a conclut que l\u2019appr\u00e9hension d\u2019une certaine quantit\u00e9 de drogue dans la voiture d\u2019un citoyen ne peut \u00eatre punie comme un acte de consommation et\/ou de possession de stup\u00e9fiants sur un lieu public.<\/p>\n\n\n\n
Le juge a bas\u00e9 sa d\u00e9cision sur le paragraphe 16 de l\u2019article 36, qui punit comme infraction grave \u201cla consommation ou la d\u00e9tention illicites de drogues toxiques, de stup\u00e9fiants ou de substances psychotropes, m\u00eame si elles n'\u00e9taient pas destin\u00e9es au trafic, dans les lieux, routes, \u00e9tablissements publics ou transports collectifs, ainsi que l'abandon des instruments ou autres effets qui leur sont destin\u00e9s dans les lieux pr\u00e9cit\u00e9s.\u201d<\/p>\n\n\n\n
Bego\u00f1a Valero, avocate de Legalion Abogados a d\u00e9fendu l'affaire et s\u2019est exprim\u00e9 sur le sujet : \"le tribunal consid\u00e8re que le v\u00e9hicule priv\u00e9 d'un citoyen ne peut \u00eatre compris ni assimil\u00e9 \u00e0 un lieu public, surtout lorsque la norme est particuli\u00e8rement d\u00e9taill\u00e9e avec les lieux o\u00f9 il peut \u00eatre sanctionn\u00e9 \u00bb. Valero a \u00e9galement soulign\u00e9 que ce n'est pas la premi\u00e8re fois qu'un tribunal annule une amende pour cette raison.<\/p>\n\n\n\n

Dans les cas de d\u00e9tention ou de consommation de drogues dans des lieux publics, la loi B\u00e2illon \u00e9tablit trois degr\u00e9s de champ d'application. Le premier champ correspond \u00e0 une amende de 601 \u00e0 10 400 euros. Le deuxi\u00e8me correspond \u00e0 une sanction comprise entre 10 401 et 20 200 euros. Enfin, le troisi\u00e8me correspond \u00e0 une amende comprise entre 20 201 et 30 000 euros. Les crit\u00e8res pris en compte pour fixer le montant de l\u2019amende d\u00e9pendent du risque pour la s\u00e9curit\u00e9 des citoyens ou la sant\u00e9 publique, le montant des dommages caus\u00e9s et la capacit\u00e9 \u00e9conomique du contrevenant, entre autres.<\/p>\n\n\n\n
\"La quantit\u00e9 intervenue de 0,55 gramme (r\u00e9sine de cannabis), n'est pas consid\u00e9r\u00e9e comme une quantit\u00e9 faisant l'objet d'un trafic. Je consid\u00e8re que le cas en question n'est inclus dans aucun des cas pr\u00e9vus par la loi organique pour la protection de la s\u00e9curit\u00e9 des citoyens, premi\u00e8rement parce qu'il s'agit d'une petite quantit\u00e9 de cannabis, et deuxi\u00e8mement, car il se trouve \u00e0 l'int\u00e9rieur d'un v\u00e9hicule.\u201d a expliqu\u00e9 le juge.<\/p>\n\n\n\n
Contrairement au Code p\u00e9nal, explique Bego\u00f1a Valero, la loi sur la s\u00e9curit\u00e9 citoyenne \u00absanctionne les situations qui peuvent porter atteinte \u00e0 la paix des citoyens. Outre le fait qu'elle se trouvait dans le v\u00e9hicule, la quantit\u00e9 est n\u00e9gligeable pour pr\u00e9senter un danger pour la s\u00e9curit\u00e9 publique\".<\/p>","protected":false},"excerpt":{"rendered":"
