Nous avons de bonnes nouvelles ! Lundi 24 janvier 2022, le Conseil d'\u00c9tat a suspendu le d\u00e9cret gouvernemental interdisant la vente de fleurs de CBD, la mol\u00e9cule non psychotrope pr\u00e9sente dans le cannabis.<\/p>\n\n\n\n

Malgr\u00e9 le succ\u00e8s massif du CBD, la France avait publi\u00e9 vendredi 31 d\u00e9cembre au Journal officiel un arr\u00eat\u00e9 interdisant la vente de fleurs de CBD \u00e0 fumer ou en tisane aux consommateurs<\/p>\n\n\n\n

La nouvelle est un \u00e9norme soulagement pour les entreprises fran\u00e7aises de l'industrie du CBD.<\/strong><\/p>\n\n\n\n

La plus haute juridiction administrative avait \u00e9t\u00e9 saisie par diff\u00e9rents acteurs du secteur souhaitant obtenir la suspension en urgence d'un d\u00e9cret engag\u00e9 par le gouvernement le 30 d\u00e9cembre, qui interdisait la vente et la consommation des fleurs de chanvre contenant du cannabidiol (CBD).<\/p>\n\n\n\n

\"Le minist\u00e8re a essay\u00e9 de d\u00e9fendre un argument de sant\u00e9 publique qui de toute fa\u00e7on n'avait aucun sens\", a r\u00e9agi Me Uzan-Sarano, avocat du syndicat du chanvre.<\/p>\n\n\n\n

Le Conseil d'\u00c9tat a pr\u00e9cis\u00e9 que les fleurs et feuilles de chanvre ayant une teneur en THC inf\u00e9rieure \u00e0 0,30 % ne sont pas nocives pour la sant\u00e9 et ne justifient pas une interdiction g\u00e9n\u00e9rale et absolue de leur vente aux consommateurs.<\/p>\n\n\n\n

\"Pour nous, c'\u00e9tait une \u00e9pine dans le pied, on \u00e9tait d\u00e9sesp\u00e9r\u00e9, et \u00e7a a remis en cause toute la fili\u00e8re. L'horizon se d\u00e9gage, mais tout reste \u00e0 faire\", s'est r\u00e9joui Aur\u00e9lien Delecroix, pr\u00e9sident du syndicat du chanvre. <\/p>\n\n\n\n

\"C'est une d\u00e9cision qui d\u00e9montre la ma\u00eetrise du droit europ\u00e9en, l\u00e0 o\u00f9 le gouvernement veut faire un coup politique\", a d\u00e9clar\u00e9 Xavier Pizarro, avocat de l'Union des professionnels du CBD. <\/p>\n\n\n\n

La d\u00e9cision fait suite \u00e0 la d\u00e9claration de la Cour de justice de l'Union europ\u00e9enne.<\/strong><\/p>\n\n\n\n

En novembre 2020, la Cour de justice de l'Union europ\u00e9enne avait d\u00e9j\u00e0 d\u00e9clar\u00e9 que l'interdiction du CBD en France \u00e9tait ill\u00e9gale. Selon le principe de libre circulation des marchandises, le CBD est l\u00e9gal dans plusieurs autres pays europ\u00e9ens.<\/p>\n\n\n\n

La justice europ\u00e9enne a estim\u00e9 que le CBD n'avait pas d'effet nocif sur la sant\u00e9 et ne pouvait \u00eatre consid\u00e9r\u00e9 comme un stup\u00e9fiant, contrairement \u00e0 sa mol\u00e9cule jumelle, le THC, que l'on trouve actuellement sur le march\u00e9 noir et dont les effets sont psychotropes.<\/p>\n\n\n\n

La Cour de cassation, la plus haute juridiction de l'ordre judiciaire fran\u00e7ais, soutient cette affirmation et estime que le CBD produit l\u00e9galement dans l'UE peut \u00eatre vendu en France.<\/p>\n\n\n\n

La France comptait environ 400 boutiques CBD d\u00e9but 2021. Aujourd'hui, il y en a presque quatre fois plus. Les syndicats ont estim\u00e9 le chiffre d'affaires du secteur \u00e0 un milliard d'euros, dont les deux tiers proviennent de la vente de fleurs de CBD.<\/p>","protected":false},"excerpt":{"rendered":"
