Vendredi dernier, le gouvernement fran\u00e7ais a publi\u00e9 un d\u00e9cret au Journal officiel pr\u00e9cisant le nouveau cadre d'industrialisation et de commercialisation du CBD. L'utilisation du CBD sera d\u00e9sormais limit\u00e9e \u00e0 la \u00ab production industrielle d'extraits de chanvre \u00bb destin\u00e9s \u00e0 l'alimentation ou \u00e0 la cosm\u00e9tique.&nbsp;<\/p>\n\n\n\n<p><strong>La France reste en guerre contre l'utilisation industrielle et commerciale du CBD.&nbsp;<\/strong><\/p>\n\n\n\n<p>Malgr\u00e9 le succ\u00e8s massif de la mol\u00e9cule de cannabis non psychotrope gr\u00e2ce \u00e0 ses propri\u00e9t\u00e9s relaxantes, la France a publi\u00e9 vendredi 31 d\u00e9cembre un arr\u00eat\u00e9 au Journal officiel interdisant la vente de fleurs et de feuilles de CBD \u00e0 fumer ou en tisane.&nbsp;<\/p>\n\n\n\n<p>\"La vente de fleurs ou de feuilles sous toutes leurs formes, seules ou m\u00e9lang\u00e9es avec d'autres ingr\u00e9dients, leur possession et leur consommation\" est interdite, d\u00e9taille le texte.&nbsp;<\/p>\n\n\n\n<p>En outre, \"la culture, l'importation, l'exportation et l'utilisation industrielle et commerciale\" ne seront autoris\u00e9es que pour les \"vari\u00e9t\u00e9s de Cannabis sativa L.\"&nbsp;<\/p>\n\n\n\n<p>La plante de chanvre doit contenir du t\u00e9trahydrocannabinol - THC, une mol\u00e9cule psychotrope - qui ne devra pas d\u00e9passer 0,3%, contre 0,2% compar\u00e9 au d\u00e9cret publi\u00e9 en juillet 2021.&nbsp;<\/p>\n\n\n\n<p>Ces vari\u00e9t\u00e9s doivent en outre \u00eatre inscrites au catalogue des types de plantes agricoles ou au r\u00e9pertoire officiel des esp\u00e8ces et vari\u00e9t\u00e9s de plantes cultiv\u00e9es en France. Par ailleurs, les fleurs et feuilles de ces vari\u00e9t\u00e9s \"ne peuvent \u00eatre r\u00e9colt\u00e9es, import\u00e9es ou utilis\u00e9es que pour la production industrielle d'extraits de chanvre\" pr\u00e9cise le d\u00e9cret.&nbsp;<\/p>\n\n\n\n<p><strong>La production de cannabis sera sous stricte surveillance&nbsp;<\/strong><\/p>\n\n\n\n<p>L'achat de fleurs et feuilles de chanvre produites sur le territoire fran\u00e7ais doit faire l'objet d'un contrat \u00e9crit entre le producteur et l'acheteur.<\/p>\n\n\n\n<p>En outre, les produits \u00e0 base de chanvre \u00ab ne peuvent \u00eatre import\u00e9s de pays hors Union europ\u00e9enne ou export\u00e9s que s'ils sont accompagn\u00e9s de documents attestant de leur conformit\u00e9 \u00bb. Enfin, la vente de semences et la pratique du bouturage sont interdites.&nbsp;<\/p>\n\n\n\n<p><strong>Un nouveau d\u00e9cret notifi\u00e9 \u00e0 la Commission europ\u00e9enne&nbsp;<\/strong><\/p>\n\n\n\n<p>Suite \u00e0 l'arr\u00eat rendu par la Cour europ\u00e9enne de justice en novembre 2020, les autorit\u00e9s fran\u00e7aises ont transmis le nouveau d\u00e9cret \u00e0 la Commission europ\u00e9enne. Le document r\u00e9vise un texte qui date de 1990&nbsp;<\/p>\n\n\n\n<p>En novembre 2020, l'UE avait rejet\u00e9 le projet de loi fran\u00e7ais en soutenant que le CBD \u00e9tait une mol\u00e9cule inoffensive et ne pouvait donc pas \u00eatre consid\u00e9r\u00e9 comme un stup\u00e9fiant. L'UE a \u00e9galement fait valoir que la libre circulation des marchandises au sein de l'UE s'appliquait au CDB.&nbsp;<\/p>\n\n\n\n<p>Malgr\u00e9 la r\u00e9glementation europ\u00e9enne autorisant la vente de CBD, le gouvernement fran\u00e7ais a r\u00e9cemment ferm\u00e9 des dizaines de magasins vendant des produits de CBD.&nbsp;<\/p>\n\n\n\n<p>Le 23 juin, la Cour de cassation a jug\u00e9 que le CBD pouvait \u00eatre vendu en France s'il \u00e9tait produit dans un autre pays europ\u00e9en toutefois n\u2019avait pas approch\u00e9 l\u2019interdiction de commercialisation au nom de la protection de la sant\u00e9 publique.&nbsp;<\/p>","protected":false},"excerpt":{"rendered":"<p>France is going backward!
