Les membres des Premi\u00e8res Nations invoquent la \u00abpharmacop\u00e9e traditionnelle\u00bb et la primaut\u00e9 des lois autochtones sur les lois canadiennes pour justifier l\u2019ouverture de leurs magasins.<\/p>\n\n\n\n<p>\u00abIci, la province de Saskatchewan n'existe plus\u00bb, a m\u00eame d\u00e9clar\u00e9 le chef Ira McArthur \u00e0 Radio-Canada. McArthur est \u00e0 la t\u00eate du Pheasant Rump Nakota, une tribu d'environ 100 personnes vivant dans une r\u00e9serve am\u00e9rindienne du Saskatchewan, une province rurale du centre du Canada. La communaut\u00e9 soutient que les lois provinciales et f\u00e9d\u00e9rales ne s'appliquent pas sur leur territoire puisque la loi autochtone prend le relais. Selon eux, la communaut\u00e9 peut vendre du cannabis sans l\u2019accord du gouvernement.<\/p>\n\n\n\n<p>Plus au nord, les tribus de Peepeekisis (700 personnes) et de Muscowpetung (500 habitants) se battent pour la m\u00eame cause.<\/p>\n\n\n\n<p class=\"has-large-font-size\"><strong>Les revenus des Am\u00e9rindiens sont nettement inf\u00e9rieurs<\/strong><\/p>\n\n\n\n<p>Un peu plus \u00e0 l'ouest, dans la province de Colombie-Britannique, un autre am\u00e9rindien du nom de Cory Brewer a ouvert un magasin de cannabis en dehors de son territoire communautaire.<\/p>\n\n\n\n<p>Membre de la nation Syilx, il base ses arguments sur la D\u00e9claration des Nations Unies sur les Droits des Peuples Autochtones de 2007. Il d\u00e9clare entre autres que: \"Les peuples autochtones ont droit \u00e0 leur pharmacop\u00e9e traditionnelle et ils ont le droit de maintenir leurs propres pratiques m\u00e9dicales.\"<\/p>\n\n\n\n<p>Pour les avocats sp\u00e9cialistes interrog\u00e9s par Radio-Canada, cette loi s'applique aux collectifs et non aux particuliers.<\/p>\n\n\n\n<p>\u00c0 l'instar de l'Australie ou des \u00c9tats-Unis, le Canada n'a pas vot\u00e9 pour la D\u00e9claration des Nations Unies sur les Droits des Peuples Autochtones. Ces trois pays partagent un pass\u00e9 de colonisation tr\u00e8s violent en faveur duquel les communaut\u00e9s exigent une reconnaissance minimale de leurs droits.<\/p>\n\n\n\n<p>La situation de ces communaut\u00e9s autochtones reste \u00e0 l\u2019heure actuelle toujours difficile. Un article r\u00e9dig\u00e9 par des chercheurs et publi\u00e9 dans la prestigieuse Encyclop\u00e9die canadienne d\u00e9crit la situation actuelle des Am\u00e9rindiens comme \u00abune marginalisation politique et \u00e9conomique\u00bb. Ces communaut\u00e9s souffrent d'un \u00abtaux de ch\u00f4mage deux fois plus \u00e9lev\u00e9 que celui des non-Autochtones.
