Selon les donn\u00e9es du minist\u00e8re de l'Int\u00e9rieur, les amendes ont \u00e9t\u00e9 multipli\u00e9es par 3,5 depuis l'approbation de la loi b\u00e2illon.&nbsp;<\/p>\n\n\n\n<p>En comparaison, l'Allemagne inflige environ 179 000 amendes par an malgr\u00e9 une population presque deux fois plus nombreuse et un taux de consommation l\u00e9g\u00e8rement inf\u00e9rieur \u00e0 celui de l'Espagne.&nbsp;<\/p>\n\n\n\n<p>Aucun autre pays europ\u00e9en ne d\u00e9passe 200 000 amendes par an. L'Allemagne prend la deuxi\u00e8me position avec 179 700 amendes, puis viennent la Turquie et l'Italie, bien loin derri\u00e8re, avec 53 734 et 33 363 amendes respectivement.<\/p>\n\n\n\n<p><strong>What does the law say?<\/strong><\/p>\n\n\n\n<p>Francisco Azor\u00edn, avocat au cabinet d'avocats Brotsanbert, estime qu'une partie du probl\u00e8me est due \u00e0 la culture des forces de l'ordre de punir m\u00eame lorsqu\u2019il n\u2019y a pas de preuve de transport de drogue dans les espaces publics et de \"fouilles disproportionn\u00e9es et arbitraires\".<\/p>\n\n\n\n<p>Azor\u00edn vient de publier un livre intitul\u00e9 \u201cCannabis, Science and Law\u201d, dans lequel il passe en revue la situation juridique du cannabis en Espagne et les probl\u00e8mes rencontr\u00e9s par ses utilisateurs.<\/p>\n\n\n\n<p>\u00abDans le reste de l'Europe, malgr\u00e9 qu\u2019ils aient des lois plus strictes concernant la culture du cannabis, la simple possession n'est g\u00e9n\u00e9ralement pas sanctionn\u00e9e par des amendes, du moins pas la premi\u00e8re fois\u00bb, dit Azor\u00edn.<\/p>\n\n\n\n<p>La situation est un r\u00e9el probl\u00e8me pour les usagers qui voient les amendes s'accumuler alors que les autorit\u00e9s appliquent des sanctions de plus en plus lourdes en cas de r\u00e9cidive.&nbsp;<\/p>\n\n\n\n<p>Azor\u00edn a trait\u00e9 une affaire dans laquelle un jeune homme a re\u00e7u une amende de 10 401 euros pour avoir transport\u00e9 un joint et un peu de cannabis dans sa poche, pas m\u00eame pour consommation sur la voie publique.&nbsp;<\/p>\n\n\n\n<p>\u00abJ'ai un client avec 62 000 euros qui a \u00e9t\u00e9 p\u00e9nalis\u00e9 pour avoir transport\u00e9 du cannabis dans sa poche, vous pouvez imaginer dans quel \u00e9tat de sant\u00e9 mentale il est \u00e0 l\u2019heure actuelle\u00bb, explique l'avocat.&nbsp;<\/p>\n\n\n\n<p>\u00abPour effectuer une fouille, elle doit \u00eatre consid\u00e9r\u00e9e comme n\u00e9cessaire, c'est-\u00e0-dire qu'il doit y avoir des preuves d'activit\u00e9 criminelle, ce que la police ne peut g\u00e9n\u00e9ralement pas prouver lors d'un proc\u00e8s.
