Un juez anul\u00f3 una multa de 601 euros a un hombre al que sorprendieron con 0,55 gramos de cannabis dentro de su coche. <\/p>\n\n\n\n
La ley Mordaza, conocida como ley de seguridad ciudadana, est\u00e1 en vigor desde 2015. Esta ley castiga la posesi\u00f3n o consumo de drogas en la calle y lugares o transporte p\u00fablico con una multa entre 601 y 30.0000 euros. Sin embargo, la ley no especifica si se puede fumar dentro de un veh\u00edculo estacionado en un \u00e1rea p\u00fablica. <\/p>\n\n\n\n

La sentencia concluy\u00f3 que la aprehensi\u00f3n de una peque\u00f1a cantidad de droga en el autom\u00f3vil de un ciudadano no puede ser sancionada como un acto de consumo y\/o posesi\u00f3n de estupefacientes en un lugar p\u00fablico.<\/p>\n\n\n\n
El juez bas\u00f3 su decisi\u00f3n en el art\u00edculo 36 del p\u00e1rrafo 16, que sanciona como infracci\u00f3n grave \u201cel consumo o la tenencia il\u00edcita de drogas t\u00f3xicas, estupefacientes o sustancias psicotr\u00f3picas, aunque no est\u00e9n destinadas al tr\u00e1fico, en lugares, v\u00edas, establecimientos p\u00fablicos o transporte p\u00fablico, as\u00ed como el abandono de instrumentos y otros efectos destinados a ellos en los lugares mencionados antes\u201d.<\/p>\n\n\n\n
Bego\u00f1a Valero, abogada de Legalion Abogados defendi\u00f3 el caso y explic\u00f3: \u201cel tribunal considera que el veh\u00edculo particular de un ciudadano no puede entenderse ni asimilarse como un lugar p\u00fablico cuando la norma detalla especialmente los lugares donde puede ser sancionado\u201d. Valero tambi\u00e9n se\u00f1al\u00f3 que no es la primera vez que un juzgado cancela una multa por este motivo.<\/p>\n\n\n\n

En los casos de posesi\u00f3n o consumo de drogas en lugares p\u00fablicos, la Ley Mordaza establece tres grados de gravedad. El de primer grado corresponde a una multa de entre 601 y 10.400 euros. El segundo corresponde a una multa de entre 10.401 y 20.200 euros. Finalmente, el tercero corresponde a una multa de entre 20.201 y 30.000 euros. Los criterios que se toman en cuenta para fijar el importe de la multa dependen del riesgo para la seguridad de los ciudadanos, el importe del da\u00f1o ocasionado y la capacidad econ\u00f3mica del infractor, entre otras razones.<\/p>\n\n\n\n
\u201cLa cantidad de 0,55 gramos de resina de cannabis no es para vender. Considero que el caso en cuesti\u00f3n no est\u00e1 incluido en ninguno de los supuestos previstos por la ley org\u00e1nica para la protecci\u00f3n de la seguridad ciudadana, en primer lugar porque se trata de una peque\u00f1a cantidad de cannabis, y en segundo lugar porque est\u00e1 dentro de un veh\u00edculo\", explic\u00f3 el juez.<\/p>\n\n\n\n
A diferencia del C\u00f3digo Penal, explic\u00f3 Bego\u00f1a Valero, la Ley de Seguridad Ciudadana \u201csanciona situaciones que pueden atentar contra la tranquilidad de los ciudadanos.
