\u00a1Tenemos buenas noticias! El lunes 24 de enero de 2022, el Consejo de Estado suspendi\u00f3 el decreto gubernamental que prohib\u00eda la venta de flores de CBD, la mol\u00e9cula no psicotr\u00f3pica del cannabis.<\/p>\n\n\n\n

A pesar del \u00e9xito masivo del CBD, Francia public\u00f3 un decreto en el Diario Oficial el viernes 31 de diciembre prohibiendo la venta de flores para fumar y para infusiones a los consumidores.<\/p>\n\n\n\n

La noticia es un gran alivio para las empresas francesas en la industria del CBD.<\/strong><\/p>\n\n\n\n

El tribunal administrativo hab\u00eda sido ocupado por varios actores del sector que quer\u00edan obtener la suspensi\u00f3n urgente de un decreto emitido por el gobierno el 30 de diciembre, que prohib\u00eda la venta y consumo de flores de cannabidiol (CBD).<\/p>\n\n\n\n

\"El ministerio trat\u00f3 de defender un argumento de salud p\u00fablica que no ten\u00eda sentido\", reaccion\u00f3 el Sr. Uzan-Sarano, abogado del sindicato del c\u00e1\u00f1amo.<\/p>\n\n\n\n

El Consejo de Estado afirm\u00f3 que las flores de c\u00e1\u00f1amo con un contenido de THC inferior a 0,30% no son peligrosas para la salud y no justifican una prohibici\u00f3n general y absoluta de su venta a los consumidores.<\/p>\n\n\n\n

\"Para nosotros fue una espina en el costado, estuvimos desesperados. El horizonte se despeja, pero queda mucho que hacer\", dij\u00f3 Aur\u00e9lien Delecroix, presidente del sindicato del c\u00e1\u00f1amo. <\/p>\n\n\n\n

\u201cEs una decisi\u00f3n que demuestra el dominio del derecho europeo, en el que gobierno quier\u00eda dar un golpe pol\u00edtico\u201d, dijo Xavier Pizarro, abogado del Sindicato de Profesionales del CBD. <\/p>\n\n\n\n

La decisi\u00f3n se ali\u00f1a con la declaraci\u00f3n del Tribunal de Justicia de la Uni\u00f3n Europea.<\/strong><\/p>\n\n\n\n

En noviembre de 2020, el Tribunal de Justicia de la Uni\u00f3n Europea ya hab\u00eda declarado que la prohibici\u00f3n del CBD en Francia era ilegal. De acuerdo con el principio de libre circulaci\u00f3n de mercanc\u00edas, el CBD es legal en varios otros pa\u00edses europeos.<\/p>\n\n\n\n

La justicia europea consider\u00f3 que el CBD no ten\u00eda ning\u00fan efecto nocivo para la salud y no pod\u00eda ser considerado como un estupefaciente, a diferencia de su mol\u00e9cula gemela, el THC, que se puede encontrar en el mercado negro y que est\u00e1 dotada de efectos psicotr\u00f3picos.<\/p>\n\n\n\n

El Tribunal de Casaci\u00f3n, el tribunal del orden judicial franc\u00e9s con m\u00e1s poder, estuvo de acuerdo con esa afirmaci\u00f3n y consider\u00f3 que el CDB producido legalmente en la UE se puede vender en Francia.<\/p>\n\n\n\n

Francia ten\u00eda alrededor de 400 tiendas CBD al principio de 2021. Los sindicatos estimaron la facturaci\u00f3n del sector alreadedor de mil millones de euros, dos tercios de los cuales vienen de la venta de flores.<\/p>","protected":false},"excerpt":{"rendered":"
